Welcome to Offshorejob.eu, a specialized virtual consultancy, advice and job offer/job search space, where employers can post information about available job vacancies in our Job Offers section (further – Advertisements) and people in search of a job can improve their skills using advice from offshorejob.eu materials, ask and look for informational help, place their posts (further – CV’s), read Advertisements, look for Advertisements and use other consultancy Services.

By activating the link „I Accept the Terms and Conditions“ you confirm the agreement between joint stock company „Gartruda“ (legal entity code 303095608, email address info@offshorejob.eu) (further – Offshorejob.eu or JSC „Gartruda“) and you (further – Candidate) regarding the use of Offshorejob.eu website (further – Website). These Terms and Conditions are not a recruitment services agreement.

By using our Website you confirm that you have read and accepted the terms and conditions of this agreement (further – Agreement) and you agree to comply with these terms and conditions.

Using the Website in terms of this Agreement means all and any actions undertaken when the Candidate connects to the site via Internet. In terms of this Agreement, services (further Services) include all and any actions that he or she can undertake on the Website, including but not limited to posting Advertisements, reading information that has been posted, writing questions, comments and reviews, supplying any type of information and/or supplying, sending or receiving data (further referred to as Services). The Candidate by using the Website and/or Services in any way or form unconditionally and irrevocably agrees to keep to all terms and conditions of this Agreement. If the Client does not agree to keep to all the terms and conditions of this Agreement, he or she does not have the right to use any Services and or this Website.

Some of the services on this Website are provided to the Candidate for remuneration (further – Paid Services). Paid Services are defined and described on the Website. The price for Paid Services is indicated on the order page of specific services. Henceforth, the term „Services“ will refer to all Services, including Paid Services, and the term „Paid Services“ will refer only to those services for which the Candidate provides monetary remuneration.

In addition to this Agreement, the relationship between the Candidate and Offshorejob.eu is regulated by the Laws of the Republic of Lithuania and good business practices.

1. Candidate’s Rights, Obligations and Commitments

1.1. I submit my CV on Offshorejob.eu Website seeking to find job offers and apply for the jobs on my own.

1.2. My information will be visible to the registered Offshorejob. Clients searching for employees.

1.3. My information will not be accesible to the parties unrelated to the services provided by Offshorejob.eu.

1.4. I agree that my information can be checked by Offshorejob.eu employees in efforts to provide only truthful and understandable information to the employers.

1.5. I can edit or delete my information.

1.6. Offshorejob.eu has the right to collect, store, edit, manage and provide the employers with the sumbited information and to use it for the purposes of the employers searching for employees.

1.7. I agree that Offshorejob.eu will manage and administer my personal information in keeping with the laws of the Republic of Lithuania.

1.8. www.offshorejob.eu consultants have the right to delete information that is untruthful or inappropriately submitted as well as delete my CV in case of my inappropriate actions toward the employers, the system or other parties involved in providing the services because of which the above mentioned parties can experience moral or material damages or losses.

1.9. I assume responsibility for the submitted information which has to be truthful and accept that I will take responsibility for the damages and losses that can be incurred as a result of submitting false information.

1.10. I understand and accept that Offshorejob.eu shall not be held responsible for the damages or losses that can be incurred because of the offers, promises or other employment related actions of the companies searching for employees registered on the Website.

1.11. I understand that www.offshorejob.eu consultants do not commit to find my employment and that the job offers posted on the Website are posted by the third parties, that is employers who use Offshorejob.eu services.

2. The Rights and Obligations of Offshorejob.eu

2.1. Offshorejob.eu reserves the right to limit or discontinue the Candidate’s right or access to use the Website, including altering any information that the Candidate posted on the Website, deleting the Candidate’s CV, deleting and banning Candidate’s account and banning the Candidate from registering on the Website again if the Candidate:

2.1.1. Does not keep the Terms and Conditions or does not keep his or her obligations as outlined by these Terms and Conditions;

2.1.2. Supplies faulty, incomplete or misleading information when registering or using the Website;

2.1.3. Intentionally and consciously publicizes faulty or misleading information on the Website or engages in other inappropriate activity, as deemed by Offshorejob.eu;

2.2. Offshorejob.eu has the right (but not an obligation):

2.2.1. To monitor the activity of the Candidate on the Website at any time, including monitoring the CVs posted by the Candidate, Offshorejob.eu has the right to investigate any violation of Terms and Conditions using legally acceptable means;

2.2.2. Delete the Candidate’s CV or any other information posted by the Candidate at their own discretion, if it is deemed to violate the Terms and Conditions, the laws or are contrary to good morals.

2.2.3. To delete the Candidate’s account at its own discretion if the Candidate receives no fewer than two negative reviews or comments from the employer. When the Candidate receives the third negative comment or review, Offshorejob.eu will delete the Candidate’s account. The account will be deleted automatically. The Candidate has the right to appeal the decision to delete the account by sending the letter to the email address info@offshorejob.eu. The decision made by Offshorejob.eu is final.

2.3. Offshorejob. has the right to receive payment for Paid Services according to the prices indicated on the Website. Offshorejob.eu will present the receipt at the request of the Candidate.

2.4. The Parties agree that Offshorejob.eu has the right to discontinue the activity of the Website at any time without prior notice.

3. Limitation of Liability

3.1. Offshorejob.eu does not act as an intermediary in Candidate’s search for employment or signing employment contracts with an employer. These Terms and Conditions are not a mediation agreement between the Candidate and Offshorejob.eu. The Candidate assumes full responsibility for negotiation process with employers and its outcomes.

3.2. Offshorejob.eu does not guarantee nor can be held legally accountable that Candidate upon using the Website will sign an employment contract with an employer. Offshorejob.eu is not responsible for the negotiation process between the Candidate and the employer. Offshorejob.eu does not take any initiative in forming relationships between Clients and Candidates.

3.3. Offshorejob.eu does not assume responsibility for the content of information that is provided, its truthfulness and shall not be held responsible for the damages or losses experienced by the Candidate or any third parties or computer systems. Offshorejob.eu shall not be held responsible for the publication of logos, banners or the reliability or security of information posted on the websites of third parties.

3.4. Offshorejob.eu shall not be held responsible for any losses that may be incurred due to the use of information and/or pictures used in Advertisements and/or CVs.

3.5. Offshorejob.eu reserves the right to change these Terms and Conditions without any prior notice.

3.6. The candidate upon registering an account in Offshorejob.eu system becomes the manager of his or her personal information (email and password). The Candidate guarantees the confidentiality of this information and is fully responsible for the actions of persons who will connect to the account in his or her name.

3.7. The Candidate commits to ensuring that Offshorejob.eu will never face any legal responsibility, obligation to pay, remunerate or otherwise compensate any losses, damages or other expenses incurred by the Candidate’s use of this Website and/or Services.

4. Data Protection and Privacy

4.1. The Candidate agrees and recognizes that he or she provides the CV and personal information out of his or her own free will for the purpose of posting the information on the Website, so that the employers and Offshorejob.eu could freely access this information, review and copy it, and so that the Candidate’s information could be saved and electronically administered in the Website’s database.

4.2. Offshorejob.eu guarantees that the information about Candidate’s credit card or bank account received in the process of providing Paid Services will not be stored and used for any other activity unrelated to providing Offshorejob.eu Services.

4.3. Offshorejob.eu provides Paid Services utilizing a partner payment system SKRILL and PAYPAL. Offshorejob.eu shall not be held responsible for the quality of service or data security provided by the partner, but guarantees that the partner (SKRILL/PAYPAL) is a competent service provider that has all the necessary security certificates and licenses and meets the standards of EU (SKRILL Terms & Conditions).

4.4. The Candidate agrees that his or her information will be used for indirect purposes – user need analysis and identification, direct marketing, service quality improvement, Website usability improvement and other legitimate purposes. Automated email responses about Candidate, CV or other changes are an integral part of the Services provided by Offshorejob.eu

4.5. Offshorejob.eu reserves the right to track Candidate’s IP addresses. In case of legitimate complaints about the content of the CV, the IP address of the Client can be provided to the interested governmental institutions.

4.6. Offshorejob.eu guarantees that the information from the Website’s database will not be handed over to other organizations or third parties for the purposes of advertisement.

4.7. The copyrights and other rights to the website www.offshorejob.eu belong exclusively to JSC „Gartruda“. All trademarks, design elements and other textual or graphic information used in the Website are the property of JSC „Gartruda“ or JSC „Gartruda“ has the rights to use it.

4.8. It is prohibited to reproduce all or parts of the Website in any form or way without an explicit written permission by JSC „Gartruda“ It is prohibited to perform any actions by which JSC “Gartruda” rights to this website may be violated or any actions that would violate the principles of copyright laws.

4.9. The Candidate by posting the CV agrees that the content of the CV, including any intellectual property, would become a part of the Website’s database and would be stored and administered by JSC “Gartruda” in ways warranted by the law for an unlimited period of time unless indicated otherwise in the Terms and Conditions.

4.10. These Data Protection and Privacy rules can change without any prior notice. The changes will be publicly announced on the Website.

5. Paid Services

5.1. Paid Services and the use of procedure is described and indicated on the Website and their price is indicated on each individual Paid Service’s order page.

5.2. The Candidate understands and accepts that the Paid Services will be provided only after the Candidate pays Offshorejob.eu for Paid Services as outlined in the Website. Offshorejob.eu has the right to change the price and the payment procedure for any Paid Services unilaterally.

5.3. All Paid Services are paid for only through SKRILL/ PAYPAL payment systems (Terms and Conditions paragraph 4.3).

5.4. The Candidate understands that using Paid Services is not a necessary condition to receive a job offer from an employer.

5.5. In case the Candidate’s access to Paid Services was restricted or terminated or in case the Candidate does not receive Paid services or does not receive Paid Services on time for other reasons, Offshorejob.eu guarantees that at the request of the Candidate it will extend the Candidate’s use of Paid Services for the duration of time that the Services were not provided or to provide Services equitable to the Paid Services that were not rendered for free (if the Paid Services are not of continuous nature).

5.6. Offshorejob.eu has the right to restrict or terminate the Services for an unlimited time for the purposes of Website maintenance.

6. Final Provisions

6.1. If any provision of these Terms and Conditions is contrary to the law, or for any reason becomes partially or completely invalid, it does not invalidate the remaining provisions.

6.2. The Terms and Conditions are subject to the law of the Republic of Lithuania.

6.3. The Parties agree that all disputes and claims that arise from or are related to the Agreement will be resolved through negotiations. If the Parties cannot come to agreement the dispute is submitted to the regional court of Offshorejob.eu location according to the procedures specified in the Law of the Republic of Lithuania.

6.4. The Terms and Conditions come into force from the moment when the Candidate confirms that he or she accepts them and remain binding for the entire duration of the relationship between the Candidate and Offshorejob.eu.

The Client by using the Website and/or Services in any way or form unconditionally and irrevocably agrees to keep to all terms and conditions of this Agreement. If the Client does not agree to keep to all the terms and conditions of this Agreement, he or she does not have the right to use any Services and/or this Website.

1. Client’s Rights, Obligations and Commitments

1.1. The Client by registering on the Website confirms that he or she has the right to represent the Employer and has the authority to enter this Agreement.

1.2. The Client guarantees that the information provided about them on the Website is correct.

1.3. The Client upon the creation of account becomes the administrator of this information (email and password). The Client guarantees the security of this information and assumes full responsibility for the actions of the persons who log in in their name.

1.4. The Client agrees to receive commercial and other offers from Offshorejob.eu The Client has the right to refuse to receive these offers by informing Offshorejob.eu about this.

1.5. The Client commits to providing the Candidates with full and correct information about job vacancies when posting job offers or using Offshorejob.eu database, including information about the Client’s Enterprise, job description, requirements for Candidates and contact information. The Client when posting a job vacancy has to really hire for the job advertised. Posting of information that is not true is strictly prohibited.

1.6. The Law of Equal Opportunities prohibits posting job offers which indicates a priority for certain candidates on the basis of discrimination outlined by the Law (gender, race, ethnicity, language, origin, social status, faith, belief or convictions, age, sexual orientation, disability, ethnic belonging or religion). The Client commits to considering these requirements prior to posting the Advertisement.

1.7. It is prohibited to post Advertisements that are contrary to the Laws the Republic of Lithuania or commonly accepted moral norms. Offshorejob.eu can edit or delete such Advertisements without prior notice.

1.8. The Client will not share the information about the Candidates with the third parties without an explicit permission from Offshorejob.eu unless required to do so by the law.

1.9. The Client will use the personal information about the Candidates within keeping of the law and Terms and Conditions and for the purposes of employment only. The Advertisement can only be posted in the designated section of the Website. By posting pictures in the Advertisement the Client guarantees that he or she has the right to use the pictures and the use of these pictures does not violate the rights of any third party. The Client assumes full responsibility for making sure the content of the Advertisement is in keeping with the Terms and Conditions.

1.10. The Client commits to paying the damages or losses that he or she or their representatives might inflict on Offshorejob.eu or the Candidates.

1.11. No party will be held responsible for the circumstances that occur as a result of unforeseen circumstances (Force Majeure) as they are defined by the laws of the Republic of Lithuania.

2. The Rights and Obligations of Offshorejob.eu

2.1. Offshorejob.eu reserves the right to limit or discontinue the Client’s right or access to use the Website, including altering any information that the Client posted on the Website, deleting the Advertisement by the Client, deleting and banning Client’s account and banning the Client from registering on the Website again if the Client:

2.1.1. Does not keep the Terms and Conditions or does not keep his or her obligations as outlined by these Terms and Conditions;

2.1.2. Supplies faulty, incomplete or misleading information when registering or using the Website;

2.3. Offshorejob.eu has the right to receive payment for Paid Services according to the prices indicated on the Website. Offshorejob.eu will present the receipt at the request of the Client.

2.4. The Parties agree that Offshorejob.eu has the right to discontinue the activity of the Website at any time without prior notice. The Client understands and agrees that once the Client’s access to the Website of use of certain services has been terminated, Offshorejob.eu can use its discretion to determine how to delete any information about the Client.

These Terms and Conditions are not a mediation agreement between the Client and Offshorejob.eu. The Client assumes full responsibility for negotiation process with Candidates and its outcomes.

3.2. Offshorejob.eu does not guarantee nor can be held legally accountable that Client upon using the Website will sign an employment contract with a Candidate. Offshorejob.eu is not responsible for the negotiation process between the Client and the Candidate. Offshorejob.eu does not take any initiative in forming relationships between Clients and Candidates.

3.3. Offshorejob.eu does not assume responsibility for the content of information that is provided, its truthfulness and shall not be held responsible for the damages or losses experienced by the Candidate or any third parties or computer systems. Offshorejob.eu shall not be held responsible for the publication of logos, banners or the reliability or security of information posted on the websites of third parties.

3.4. Offshorejob.eu shall not be held responsible for any losses that may be incurred due to the use of information and or pictures used in Advertisements.

3.5. Offshorejob.eu reserves the right to change these Terms and Conditions without any prior notice. Offshorejob.eu commits to informing the Client about changes to the Paid Services section in writing no later than 5 days in advance before the changes take effect.

3.6. The Client commits to ensuring that Offshorejob.eu will never face any legal responsibility, obligation to pay, remunerate or otherwise compensate any losses, damages or other expenses incurred by the Client’s use of this Website and/or Services.

5.2. The Client understands and accepts that the Paid Services will be provided only after the Client pays Offshorejob.eu. Offshorejob.eu for Paid Services as outlined on the Website. Offshorejob.eu has the right to change the price and the payment procedure for any Paid Services unilaterally within keeping with the change to Terms and Conditions procedure outlined in paragraph 3.5 of the Terms and Conditions.

5.3. All Paid Services are paid for only through SKRILL payment system (Terms and Conditions paragraph 4.3).

5.4. In case the Client’s access to Paid Services was restricted or terminated or in case the Client does not receive Paid services or does not receive Paid Services on time for other reasons, Offshorejob.eu, guarantees that at the request of the Client it will extend the Client’s use of Paid Services for the duration of time that the Services were not provided or to provide Services equitable to the Paid Services that were not rendered for free (if the Paid Services are not of continuous nature).

5.5. Offshorejob.eu has the right to restrict or terminate the Services for an unlimited time for the purposes of Website maintenance.

6. Final Provisions
